This tough date is more plentiful now in AU grades than in the recent past, thanks to the Fairmont Hoard. However, nice EF 1870-s half eagles remain elusive.
No CAC approved PCGS 40 has ever sold at auction. In January 2023, Heritage sold a crappy non-CAC example for $2,100.
CAC has approved 4 in EF40 with 13 finer.
